A Comparative Analysis of Modes of Contracting: Focused On Contracting Our Garbage Collection and Welfare Facilty Operation Services

민간위탁의 계약유형에 관한 비교연구: 거래비용경제학 및 신제도이론의 적용

Abstract

This study applies theories of transaction cost economics and modes of contracting to garbage collection and welfare facilities operation services provided by Korean local governments. Contrary to the theoretical prediction, garbage collection with low transaction costs shows the characteristics of relational contracting, which were expected to be found in services with high transaction costs such as social welfare services. This study explains the conflict between these theories and practices from the perspective of the institutional theory.

이 연구는 대조적인 특성을 갖는 지방자치단체의 생활폐기물수거와 사회복지시설운영 민간위탁에 거래비용경제학이론과 계약유형을 적용하였다. 그 결과, 생활폐기물수거 민간위탁이 표준경쟁이론과 거래비용경제학이 예측한 완전계약의 특성을 보이지 않고, 관계계약의 특성을 나타냈다. 이 연구는 계약유형론의 적용을 통해서 그동안 경쟁의 부재로만 파악되어온 생활폐기물수거 민간위탁에 대해서 파트너십을 중요시하고, 분쟁해결을 위해서 비공식적 절차를 주로 사용하며, 효율성 증대를 위해서 신뢰강화를 추구한다는 특성을 명확하게 밝혀냈다. 또한, 생활폐기물수거 민간위탁에 있어서 경쟁 부재의 원인을 제도론적 시각에서 설명함으로써 규범적 대안 제시의 토대를 제공하였다.
