A Study on the Universal Welfare Polices in terms of Constitutional Value Order

보편주의 복지정책에 관한 헌법 가치적 고찰

Abstract

Universalism and selectivism about welfare polices are a point at issue that is being discussed consistently. This issue is mainly discussed as the object of political selection because the selection of welfare polices are thought of discretionary powers. But welfare policies are issue of the constitutional value order. Therefore studies are need in this viewpoint. Accordingly this paper studied the aim of welfare policies to be based of social state ideology. Therefore this paper found the adequacy of selective universalism. Furthermore, This paper shows a distinguishing standard to select the welfare policies in selective universalism.

복지정책에 있어서 그 수혜자의 범위를 어떻게 정할 것인지의 문제 즉 보편주의와 선별주의의 문제는 지속적으로 논의되어 오고 있는 쟁점사안이다. 이러한 논의는 복지정책을 국가가 정책으로 채택하면 당연히 정당성과 합법성을 갖는 입법재량 또는 정책재량의 문제로만 보았기에 주로 정치적 또는 정책적 선택의 대상으로 논의되어 왔다. 그러나 복지의 문제는 헌법의 사회국가이념에 근거하는 헌법 가치적 문제라는 점에서 이에 기초한 논의가 필요함에 틀림없다. 이에 본 논문은 헌법 상 사회국가이념에 기초하여 복지정책의 방향을 검토하였으며, 그 결과 선별주의를 원칙으로 하고 보편주의를 예외적으로 가미하는 선별적 보편주의를 채택하는 것이 가장 타당한 것으로 파악하였다. 나아가 구체적으로 사회국가의 본질인 개인의 실질적 자율성 보장과 사회개선이라는 두 가지 기준을 선별주의 또는 보편주의 복지정책을 선택하기 위한 구별기준으로 제시하였다. 즉 모든 개인에게 개성에 부합하는 자율적 생활이 가능한 상태를 보장하기 위한 일에는 선별주의가 채택되어야 하며, 정의로운 사회질서를 형성하기 위해 사회전체를 개선하는 것을 주요 내용으로 하는 경우에는 재정의 상태 등을 고려하여 보편주의 또는 선별주의를 채택할 수 있다는 것이 바로 그것이다.
